Professional Experience:
Professor Luoga is Principal Partner at FK Law Chambers and is the incumbent chairperson of the firm. He is a tax and corporate lawyer. He is the most experienced specialist consultant on tax law. His tax career dates back to the period 1988-89 when, upon graduating in law, he was attached to the Ministry of Finance, the Income Tax Department as Taxation Law Advisor (1988-1989). Between 1992 and 1994 he served as Legal Advisor to the Commissioner of Income Tax, Income Tax Department on special arrangement.  He specializes in complex tax litigation, tax planning, corporate investment, contracts, and conveyancing.  

Professor Luoga practices preventive lawyering in order to maximize the effectiveness of his services to clients. He makes legal representations on behalf of clients to tax authorities. Generally experienced in litigation both before the High Court of Tanzania and the Court of Appeal of Tanzania, Prof. Luoga represents clients before the Tax Revenue Appeals Tribunal, Tax Revenue Appeals Board, and the Court of Appeal of Tanzania.

Prof. Luoga provides consultancy services to institutions of the Government and the private sector on issues pertaining to private international trade and finance law, as well as commercial law. In this role, he served as local legal consultant to the Swedish Team on the review of the Tanzania Revenue Authority (TRA) needs (1996); legal consultant for the drafting of guidelines to be used by the TRA in handling applications for tax exemptions (1996); tax law consultant to the Team for the drafting of the subsidiary legislation under the VAT Act (1997); and legal consultant charged with the task of drafting the Tanzania Education Fund Bill (1999).

Prof Luoga has also served in projects of international significance. In this regard, he worked as legal consultant to the Team for the preparation of a Report to the European Union on behalf of the Government of Tanzania on concerns to be addressed in the negotiations for Economic Partnership Agreements (EPAs) between EU and African countries (2005-2006). He was also legal consultant to the Institute of Liberty and Democracy (ILD) at Lima in Peru on the Business and Property Formalization Project carried out under the President’s Office in Dar es Salaam (2004-2006).

Prof Luoga has also been involved, on behalf clients, in various investment negotiations. Major assignments include negotiation with prospective investors on management of the Silversands Hotel owned by the University of Dar es Salaam, under a PPP arrangement with the University of Dar es Salaam (2002) and negotiations and perfection of the ground lease for the Mlimani City Project, University of Dar es Salaam (2003).

Prof. Luoga assists investors to establish business in Tanzania. He was involved in the servicing of financing arrangements, including completing compliances for registration of documents and drafting and perfection of mortgages for the investor at the Mlimani City Project and was charged with the task of overseeing the protection and enjoyment of special tax incentives to the investors at the Mlimani City Project.

Prof. Luoga has participated in various legislative reforms. He was involved in the drafting of Regulations under the VAT Act; Drafted the Education Fund Authority Bill. He was also commissioned to the study of the Regulations under the Companies Act 2002 as well as the Tanzanian Draft Arbitration Bill and Rules and the East African Draft Arbitration Bill and Rules.  He was also appointed by the Ministry of Justice and Constitutional Affairs to be Facilitator and Rappotteur responsible for the drafting of the Report of the deliberations and recommendations on Draft Regulations under the Companies Act 2002, in particular on Insolvency Regulations (2003).

Prof. Luoga has written extensively and published on the tax and corporate law themes. He is author of A Source Book of Income Tax Law in Tanzania Dar es Salaam: DUP (1996) Limited, 1996, which has been found to be a useful and handy reference material for Tanzanian tax law students and practitioners alike.

He is an Associate Professor of law at the School of Law (formerly Faculty of Law) of the University of Dar es Salaam and currently serves as the Director of Undergraduate Studies, University of Dar Salaam.

Academic Qualifications:
PhD in Law from University of Warwick (UK); a Masters of International Law Degree from Lund University (Sweden); a Masters in Law of Queen’s University (Ontario, Canada); a Masters of International Law (with Distinction) (MIL) from Lund University (Sweden) and a Bachelor of Laws (Hons) of the University of Dar es Salaam.

Professional Qualifications:
Advocate of the High Court of Tanzania, a Notary Public and Commissioner for Oaths.
